Privacy and cookies policy

It is great that you have visited my website www.marcinurbanke.com and the way in which I process your personal data is of no concern to you. Below you will find the purposes, legal basis and duration of the processing of your personal data indicated separately for each purpose of processing.

To begin with, I want to emphasise that your data is safe with me. I ensure the confidentiality of any data provided to me, protect it from unauthorised access and take appropriate security and data protection measures as required by data protection legislation.

1. General information

1.1 The administrator of your personal data is Marcin Urbanke. If you have any questions about the privacy policy, you can contact me at any time by sending a message to rodo@marcinurbanke.com.

1.2 The RODO (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data) grants you the following rights in relation to the processing of your personal data:

  1. The right to access your data and to receive a copy of it,
  2. The right to rectification (amendment) of your data,
  3. The right to erasure (if, in your opinion, there are no grounds for us to process your data, you can request that we erase it),
  4. The right to restrict processing (you can request that processing is restricted only to the storage of data or the performance of activities agreed with you),
  5. The right to object to processing (you have the right to object to processing on the basis of a legitimate interest; you should indicate the particular situation which you think justifies us stopping the processing covered by your objection. We will stop processing your data for these purposes unless we can demonstrate that the grounds for our processing override your rights or that your data is necessary for us to establish, assert or defend claims),
  6. The right to data portability (you have the right to receive from us in a structured, commonly used machine-readable format the personal data you have provided to us on the basis of a contract or your consent; you can have this data sent directly to another entity),
  7. the right to lodge a complaint with a supervisory authority (if you find that we are processing your data unlawfully, you may lodge a complaint to the President of the Office for Personal Data Protection or any other competent supervisory authority).

The rules relating to the exercise of the rights indicated above are detailed in Articles 16 – 21 of the DPA. Please note that you can also request that I provide you with information about what data I hold about you and for what purposes I process it. Simply send an email to rodo@marcinurbanke.com

1.3 Your personal data may be processed by entities whose services I use. They may have access to your personal data if the services they provide involve or may involve the processing of personal data to the extent of such access. This includes, in particular, entities such as your web host, email service providers, website maintenance provider, law firms, marketing service providers, accounting firms, cloud software providers, etc. Please note that your data is secure and only processed to the extent necessary. In addition, if necessary, your personal data may be made available to entities, authorities or institutions entitled to access the data on the basis of the law, such as police services, security services, courts, prosecutor’s offices, as well as tax offices to the extent necessary for the performance of tax, accounting and bookkeeping duties.

1.4 We transfer your personal data to third countries in connection with the use of tools that store personal data on servers located in third countries, in particular in the USA. The providers of these tools guarantee an adequate level of protection of personal data through the relevant compliance mechanisms provided by the RODO or the use of standard contractual clauses. The storage of personal data on servers located in third countries occurs within the framework of the Google services (described in this privacy policy), whose provider is Google Ireland Limited, and within the Mailchimp mailing system.

1.5 I use tools that I may take certain actions depending on the information collected through tracking mechanisms (profiling and behavioural advertising). However, I consider that these actions do not have a material impact on you, as they do not differentiate your situation as a customer, nor do they affect the terms of the contract you may enter into with me.

2. Purposes and activities of personal data processing.

2.1 Contact.

Data to be processed: first name, e-mail address plus any data contained in the body of the message (the provision of data is voluntary but necessary to make contact).

Purpose of processing: to establish contact

Processing period: The content of the correspondence may be subject to archiving and I am not in a position to state clearly when it will be deleted.

Legal basis: article 6(1)(f) RODO, i.e. my legitimate interest. The legal basis for post-contact processing is also my legitimate purpose of archiving correspondence for internal purposes (Article 6(1)(f) RODO).

Entitlements: You have the right to request the history of any correspondence you have had with me (if it has been archived), as well as to request its deletion, unless its archiving is justified by my overriding interests, e.g. defence against potential claims on your part.

3 Cookies

3.1 Cookies and other tracking technologies.

Our website uses cookies. Cookies are small text information stored on your terminal device (e.g. computer, tablet, smartphone) that can be read by our ICT system (our own cookies) or by the ICT system of third parties (third-party cookies). Some of the cookies we use are deleted when the browser session ends, i.e. when you close your browser (so-called session cookies). Other cookies are stored on your terminal device and enable us to recognise your browser the next time you visit the website (persistent cookies).

3.2 Consent to cookies.

  • On your first visit to the website, you will be shown information about the use of cookies, together with a question about your consent to the use of cookies.
  • You can always change the cookie settings from within your browser or delete cookies altogether. Browsers manage the cookie settings in different ways. You will find explanations on how to change your cookie settings in the help menu of your browser.
  • You can also manage your cookie settings by installing special add-ons that allow you to control cookies.
  • Disabling or restricting cookies may cause difficulties in using our website, as well as many other websites that use cookies.

3.3 Server logs.

  • The use of the website involves sending requests to the server where the website is stored. Each request made to the server is recorded in the server logs.
  • The logs include, among other things, your IP address, the date and time of the server, information about the web browser and the operating system you are using.
  • The logs are saved and stored on the server. The data stored in the server logs are not associated with specific users of the website and are not used by us to identify you.
  • The server logs are only ancillary material for the administration of the site, and their contents are not disclosed to anyone other than those authorised to administer the server.

3.4 Google Analytics.

  • We use the Google Analytics tool provided by Google LLC, based in the USA.
  • The purpose is to create statistics and analyse them in order to optimise my websites.
  • The data collected is not personal and does not make it possible to identify you. The information I have access to as part of Google Analytics includes, in particular: information about the operating system and the web browser you are using, the pages you view within my site, the time you spend on my site and on its sub-pages, the source from which you navigate to my site.
  • As part of Google Analytics, I use Advertising Features such as demographic and interest reports, the age range you are in, your gender, approximate location, interests determined by your online activity.
  • In order to use Google Analytics, I have implemented a special Google Analytics tracking code in the code of my website. The tracking code uses cookies from Google LLC concerning the Google Analytics service.

3.5 Google Ads.

  • I use the Google Ads advertising programme operated by Google LLC,
  • The purpose is to run advertising campaigns, including remarketing, and the basis is the legitimate interest of marketing your own products or services.
  • The data collected is not personal data and does not make you identifiable.
  • When you visit my website, a remarketing cookie from Google is automatically left on your device which, with the help of a pseudonymous identifier (ID) and based on the pages you visit, enables interest-based advertising to be displayed.
  • Further processing of the information only takes place if you have consented to Google linking your browsing history and application usage to your account and using information from your Google account to personalise the advertisements that are displayed on the websites.
  • If, in this case, you are logged in when you visit my website on Google’s website, Google will use your data together with Google Analytics data to create and define target group lists for remarketing purposes on different devices. For this purpose, Google will temporarily combine the information collected with Google Analytics data to create the target groups.
  • In order to use Google Ads, I have implemented a special Google Ads conversion pixel in the code of my website. The pixel uses cookies from Google LLC concerning the Google Ads service. From my website, using the mechanism for managing cookies, you can disable these cookies. You can manage your ad settings directly from the Google website: https://adssettings.google.com/.
  • Details related to data processing within Google Ads at: https://policies.google.com/privacy.

3.6 Facebook Ads and Insights.

  • I use the marketing and analytics tools available through Facebook (Meta Platforms Inc., based in the USA).
  • The purpose is the marketing of their own products or services as well as analysis and statistics.
  • I have a Facebook Pixel implemented as part of my website, which automatically collects information about your use of my website in terms of the pages you view, in order to target you with advertisements personalised to your behaviour on my website.
  • The information collected as part of the Facebook Pixel does not allow you to be identified. It only allows me to see what actions you have taken within my page. I can also see what age range you are in, what gender you are, where you connect to the Internet from.
  • Details of Facebook’s privacy policy can be found at: https://www.facebook.com/privacy/explanation.

3.7 Google Tag Manager.

  • I use the Google Tag Manager tool provided by Google LLC.
  • The Google Tag Manager tool is used to manage the tags (markup) of a website via an interface. With the help of Google Tag Manager, I control the advertising campaigns I run and the way you use my website.
  • Google Tag Manager only implements tags. Its use does not involve the storing of cookies or the collection of personal data. The tool allows other tags to operate which, under certain circumstances, may collect data. However, Google Tag Manager does not access this data.
  • If the saving option has been deactivated at domain or cookie level, this will apply to all tracking tags implemented via Google Tag Manager.
  • I carry out activities in this respect based on my legitimate interest in marketing my own products or services and optimising my websites.

3.8 Hotjar.

  • I use the Hotjar tool provided by Hotjar Limited.
  • Hotjar records every visitor to my site and allows me to play a video of their traffic on my site, as well as generating so-called heat maps.
  • The Hotjar tool does not record the process of filling in the forms and therefore I do not have access to information that allows us to identify you.
  • I carry out these activities on the basis of my legitimate interest in producing statistics and analysing them in order to optimise my websites.
